1. Acceptance of Terms

By accessing or using LearnCurve ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

LearnCurve is an AI-powered adaptive learning platform that creates personalized learning plans based on your learning style. The Service allows you to enter topics, take a learning style assessment, and receive customized learning plans with curated content recommendations.

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 13 years of age to create an account. If you are under 18, you must have parental or guardian consent to use the Service.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4. Free and Paid Tiers

LearnCurve offers both free and paid subscription plans:

  • Free Tier: Limited to 1 active learning plan with basic features. No credit card required.
  • Pro Tier: Unlimited learning plans, advanced adaptation, spaced repetition, and AI tutor features. Billed monthly or annually.
  • Enterprise Tier: Team dashboards, SSO, and analytics. Billed per user per month.

Paid subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. We reserve the right to change pricing with 30 days' notice.

5. AI-Generated Content

LearnCurve uses artificial intelligence to generate learning plans, module content, and recommendations. AI-generated content may not always be accurate, complete, or appropriate. You are responsible for evaluating and verifying any information provided by the Service. LearnCurve does not guarantee the accuracy or reliability of AI-generated content.

6. User Content

You retain ownership of any content you create or upload to the Service, including notes, annotations, and learning progress data. By using the Service, you grant LearnCurve a limited, non-exclusive license to process and store your content solely for the purpose of providing the Service.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to other users' accounts or our systems
  • Reverse-engineer, decompile, or disassemble the Service
  • Use the Service to generate content that is harmful, illegal, threatening, abusive, or otherwise objectionable
  • Interfere with or disrupt the Service or servers connected to the Service
  • Share your account credentials with others
  • Use automated tools to scrape or access the Service beyond its intended use

8. Intellectual Property

The Service, its original content, features, and functionality are owned by LearnCurve and are protected by international copyright, trademark, patent, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties, or for any other reason we deem appropriate.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, and limitations of liability.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

11. Limitation of Liability

IN NO EVENT SHALL LEARNCURVE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
